This website is owned and operated by Georgia Daphne. These terms set within the terms and conditions outline how you may use our website and services offered by Georgia Daphne Photography. When purchasing a product from my website, you agree to be bound by these terms. Additionally, I reserve the right to update, change, or replace any component of these Terms and Conditions at any time and moment.
In order to utilise my website and purchase my products, you must be at least 18, or receive permission from your parental guardian before completing a payment for a tangible product.
When purchasing an item for Georgia Daphne Photography, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it, (ii) you enter a legally binding contract when you commit to buying an item and/or items when you complete the check-out payment process on the Georgia Daphne Photography website.
This website offers visitors to purchase signed, physical photographs which are delivered through Australian Post and are only available to residents living within Australia. All materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all intellectual Property Rights related thereto, are the exclusive property of 'Georgia Daphne' Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. The purchasing of photographs does not grant the individual ownership or permission to redistribute, resell, use in misleading and/or unlawful context, and to edit for resale. ​
The products sold on my website are designed for the personal use for wall art, personal projects and social media promotion with attribution to Georgia Daphne Photography, however, if my products are used of commercial use a license is required for projects including advertising campaigns, websites, and resale with an attribution to Georgia Daphne Photography. Additionally, if store front businesses wish to sell my photographs, they must contact me first and agree to mention my business name and display a Georgia Daphne Photography business card within the stores premises.
The prices we charge for the purchasing of our products are listed on the Georgia Daphne Photography website which are non-negotiable. I reserve the right to change and alter the prices for all featured products on my website at any time in order to correct pricing errors that may inadvertently occur and/or due to the rise of costs of materials and shipping.​
Refunds and returns are not permitted for any undamaged products including if the customer ordered the wrong product, entered the wrong shipping details, or someone else has placed the order without the individuals permission. The refunding and returns of undamaged products are allowed only if the incorrect product has been shipped to the customer and the customer emails me with a photograph of the incorrectly shipped item and an online invoice of the payment within 7 days of the date they received it, if this is to occur I will offer the customer the option to either receive a full refund excluding shipping based upon the original payment method used by the customer, or to return the product through the post and I will send the correct item as soon as possible once the customer confirms that they have given the incorrectly send package to Australia Post. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) refunds and returns for online gift cards are not available if the individual entered the wrong email address, or if the gift card has been used. Additionally, gift cards can only be refunded within 7 days of the payment.
I may, without prior notice, change the services; stop providing the services or any features of the services I offer; or create limits for the services. I may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason. I may, without prior notice, change intangible and tangible products; stop offering the products; or change the prices of all tangible and intangible products including services. create limits for the services.
You agree to indemnify and hold Georgia Daphne harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the Georgia Daphne Photography website or any of the services offered on the website.
To the maximum extent permitted by applicable law in the region of NSW, Australia, in no event shall Georgia Daphne, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Georgia Daphne assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content displayed on the Georgia Daphne Photography website; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of my secure servers and/or any and all personal information stored therein.
I reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. Your continued use of the Georgia Daphne Photography Website after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the Georgia Daphne Photography website.
You agree to receive from time to time promotional messages and materials from me, by mail, email or any other contact form you may provide me with (including your phone number for calls or text messages). If you do not want to receive such promotional materials or notices – please just notify me at any time and all promotional content will stop being send to you.
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Australia, NSW, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located with in the Lake Macquarie region, with zero cost to Georgia Daphne and all legal cost will be the responsibility to be paid by you, unless Georgia Daphne is founded guilty, then you will be responsible to pay for half of the legal cost. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
